do you have to pay more than what they took in your pay check? I don't think they can because there is no paycheck to take the money out of. Witholding my check is the only thing they can do. I guess I can take that as getting a break, but my checking account is now empty and my savings has been depleated. If I do go into trucking, I'd need that money to sustain me through a month of school and until I get my first paycheck. | |

| If you need to make money to be able to go to trucking school, you might try working through a temp agency like Kelly.
I did that after I graduated college and found out what an English degree was actually worth. I worked through Kelly doing temp jobs for about 6 months so I could scrape together enough money to go to a computer programming school.
I did everything from calling businesses for Dunn and Bradstreet to verify information, to reading microfiche to pulling staples from magazines so the paper could be recycled. | |

| Regardless of any agreement, they had no right to garnish wages. That can only be doine thru court order as in what they do with child support and IRS stuff. They have to take you to court to get the money, legally speaking. Call your labor board and fight it. Let them, get a nickle and dime at a time. _________________ | |

| I got some legal advise on the website Just Answers and was told because of me signing the paper agreeing to let them take money out of my paycheck, I have no legal recourse. I'm still demanding a copy of the paper I signed to see if there is some way out of it, but apart from that, all I can do is try to get them to change their minds. On the other hand, if she (HR) refuses to give me a copy then I know they're trying to get me to drop it and I WILL take action! | |

| I realized something that might work in my favor. Not only did they put the money in my account, they sent me a pay stub verifying that was the amount. They knew I was terminated almost a week before I got that money and that should have given them plenty of time to cancel the direct deposit. All I have to do is send a copy of that stub to the Texas Labor Board with my wage claim form and it might give me just the leverage I need. | |

| Well, I am up a certain creek without a certain paddle. When I signed the agreement for a payroll deduction for the damages there was a clause that said if I was fired or quit, the rest would come out of my last paychecks (they said they can even request I pay the balance later-I hope they don't try that but it's out of my hands). I heard someone today say to never sign something out of fear because it never turns out right and that is certainly the case (I was in fear of loosing my job so I signed it and lost my job anyways).
This coupled with bad decisions by me has left me in quie a pickle. I'm $3K in credit card debt because I was sure my entrance into the automotive field was going to pay off. After getting pretty deep on the credit card I lost my job with Toyota. When I got the job at Honda, I was careful with my spending but due to emergencies and low pay at first, I went the rest of the way on the credit card. When the money started really comming in I started to take advantage of the direct deposit advancements from my checking acount and spending large amounts of my paycheck before I even got it. The last DD advancements were to the tune of $300 before the incident with the engine was known. When the $900+ put into my account was already over $300 less and I moved $200 into my savings to give me $1500 (the money I had already told my dad was in savings) and spent another $200 on necessites (food, medicine, and job interview clothes). When Honda took the money back I only had $200+ and ended up having to move $1000 from my savings to cover the overdraft.
I couldn't let myself tell my dad that about my direct deposit advancements (he's lectured me time and time again about saving and keeping out of debt-obviously I seriously need to start heeding his advice) so I told him I still had $1500 in my savings and $200 in my checking. He gave me some money to hold in my checking in case I don't get unemployment and told me if I go into trucking I will need to have the $1500 to hold me until my first paycheck. Hopefully I will get unemployment and I can continue to just pay the min. amount on my CC. However, I wil need to sell some stuff to make up for the savings lost.
I have a way to bring my savings up and even reduce my CC debt, but it will be very painful for me to do so. I have some CDs that go for a higher price that I can sell on Amazon, but doesn't mean someone will buy them. I need to focus on CDs I have that I can sell on here and what I can't sell I have to be able to sell to a store (at a greatly reduced amount). So keep an eye out on my Unemployed CD sale next week as I will be adding more.
As a CD collector especially one here on HoM I have always wanted a large CD collection to match some of the legendary collectors on here. I have amassed over 1000 CDs but many of them were purchased when they shouldn't have (CC debt and direct deposit advances) so as much as it pains me and as much as it sucks to loose my goal of a large collection, my actions have forced me to part with a large portion of it. I will keep those albums that are part of a discography and my all time top albums (5 star albums only) and of course CDs that are too scratched up but I need to be willing to get rid of many, even those that are considered essential albums for a metal fan.
Of course I will still have the music on my computer (though many collectors here may find that repulsive) but not having the physical product will still hurt. I will sell many more stuff that I have but the CDs are the only stuff I own that's sure to get me some money. Once I have enough money to make up for that $1000 and some to cover my minimum CC debt for a few months, I can stop.
I have an old WWF stadium chair from a stadium that is no more that I can probably get $1-200 for and some baseball cards that I can sell for another $100 (though they are worth more). I also have tons of books and magazines but I probably would only get about $30 for all of them (if I'm lucky). So as anyone can see (if they read this, and because of the length, I won't blame them if they don't), my CD collection is my best bet to raise the money I need. This all of course is a last resort, but I need to prepare myself to be able to do this when the time comes.
BTW, I haven't dissmissed Toho's idea of getting some temp work until I make my decision on the trucking issue. | |

| Oh, I forgot. If I can't get an automotive job in the next 2-3 weeks I can sell some of my tools (keep some so I can do my own car work-I have some automotive knowledge, why not use it). Still not much I can get for them (compared to what I payed for them) but it's something. | |

Like somebody stated....daily labor/daily pay on days ya ain't interviewing. I'm talking of if I decide to become a truck driver. I haven't given up yet though, I meant to say 2-3 months. I want to apply for all automotive related jobs several times before I go that route. | |

| Yeah, keep the idea of temp work open DB.
It's great because a lot of the jobs are short term; anywhere from 1 day (like my staple-pulling job) to a couple of weeks (like my Dunn & Bradstreet job). | I have been cautioned by my dad on temp agencies in this area (and I know this from experience, I applied to some temp agencies and it went nowhere) because your often competing with illegal immagrants who don't mind working for less (back when I applied to some temp agencies, I was the only guy in the waiting room that could speak English). Maybe my youth and short job experience (excluding the Navy, I only had 4 years of job experience) was the deciding factor but when you live in a place like Texas the first scenario has to be considered.
Been going through my CDs hoping to find about 300 to sell off but I've come up short (I have about less than 240). I'm reconsidering the ones I deemed as keepers but it's not an easy decision. I'll still have the music but as a collector I'm having a hard time letting go of the hard copies. However, my need to survive must take precedence over collector integrity (I still haven't started receiving unemployment benefits). I should have a list and prices ready by the end of the week. I've decided to cancel the old thread of my sellables when I do this and just put all remaining CDs and the ones I'm working on in a new thread. | |
